4.2 AI Interview Practice (Beta)

• AI-powered interview simulation using OpenAI technology
• Voice recording and transcription (Web Speech API with OpenAI Whisper fallback)
• Automated answer evaluation and feedback
• Performance analytics and progress tracking

Note: AI Interview Practice is currently in beta. Features, accuracy, and availability may change without notice.

5. Pricing and Payment

5.1 Course Pricing

• All prices are displayed in USD unless otherwise stated
• Prices are subject to change; changes do not affect existing purchases
• Promotional pricing and discounts are subject to specific terms and expiration dates

5.2 Payment Processing

• Payments are processed securely through Stripe
• You authorize us to charge your payment method for all fees incurred
• All sales are final unless otherwise stated in our Refund Policy (Section 6)

5.3 Taxes

• Prices do not include applicable taxes unless stated
• You are responsible for all applicable taxes based on your jurisdiction

7.1 Prohibited Activities

You agree NOT to:

• Upload malicious content or attempt to compromise security
• Violate any applicable laws or regulations
• Abuse our AI services by submitting inappropriate or harmful content
• Create fake accounts or manipulate our systems

7.2 AI Interview Practice Specific Rules

• Voice recordings must be genuine interview answers, not offensive or inappropriate content
• Do not attempt to manipulate AI evaluation by submitting pre-written scripts
• Do not abuse the service to generate excessive API costs

8. Intellectual Property Rights

8.1 Our Content

• All content, questions, courses, and materials are owned by PrepMyCert or our licensors
• You receive a limited, non-exclusive, non-transferable license to access content for personal use only
• You may not reproduce, distribute, modify, or create derivative works without written permission

8.2 User Content

• You retain ownership of content you submit (e.g., interview answers, feedback)
• By submitting content, you grant us a license to use it for service improvement and AI training
• We may use anonymized data for analytics and research

9. AI Services and Limitations

9.1 AI-Generated Content

• AI feedback is generated by OpenAI models and may not always be 100% accurate
• AI evaluations are for educational purposes and do not guarantee exam success
• We are not responsible for errors or omissions in AI-generated content

9.2 Voice and Transcription

• Voice recordings are stored for up to 90 days for quality assurance
• Transcription accuracy depends on speech clarity, accent, and technical factors
• We use Web Speech API (free) with OpenAI Whisper as fallback (paid)

9.3 No Warranties

AI services are provided "as is" without warranties of:

• Accuracy, reliability, or completeness
• Fitness for a particular purpose
• Uninterrupted or error-free operation

10. Disclaimers and Limitation of Liability

10.1 No Guarantee of Exam Success

PrepMyCert provides study materials and practice resources. We do not guarantee that you will pass any certification exam. Exam success depends on individual effort, study habits, and other factors beyond our control.

10.2 Third-Party Services

• We use third-party services (OpenAI, Stripe, Azure) which have their own terms
• We are not responsible for third-party service failures or data breaches
• Outages or issues with third-party APIs may affect our services

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PrepMyCert is not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service in the past 12 months
• We are not liable for losses due to user error, account compromise, or third-party actions

11. Termination

11.1 Termination by You

• You may delete your account at any time from your dashboard
• Termination does not entitle you to a refund unless eligible under our refund policy

11.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Fail to pay for services
• Remain inactive for more than 2 years

11.3 Effect of Termination

• You will lose access to all purchased content and services
• Your data may be deleted per our retention policy
• Sections of these Terms that should survive (liability, disputes) remain in effect

12. Changes to Terms

• We may modify these Terms at any time by posting updated terms with a new "Last Updated" date
• Material changes will be notified via email
• Continued use after changes constitutes acceptance
• If you do not agree to changes, you must stop using our services

13. Dispute Resolution

Before filing a claim, you agree to contact us at support@prepmycert.com to attempt to resolve the dispute informally.

13.2 Governing Law
